Terms and Conditions Specific to the Well.ca Services Scheduling Webpage
Membership & Eligibility
In addition to the terms set forth below, Well.ca’s Terms and Conditions and Privacy Policy apply to your use of Well.ca’s Services Scheduling Webpage (the “Booking Platform”).
The scheduling, payment processing and videoconferencing capabilities of the Booking Platform are provided by third parties such as Zoom, IntakeQ and Stripe. The Booking Platform allows users to schedule, , pay for, and/or participate in virtual appointments with healthcare professionals, such as a dietitian or a naturopath (the “Healthcare Professional”) or non-professional healthcare providers such as a nutritionist, health care coordinator, doula, etc. (the “Non-Professional Healthcare Provider”) (collectively the “Provider(s)”) for remote consultations over telecommunication infrastructures such as telephone, video-conferencing and smartphones (the “Virtual Services”). The following terms and conditions apply to the use of these services, in addition to all other applicable terms and conditions referenced herein.
Conditions of scheduling an appointment
As a condition of scheduling a consultation with a Provider through the Booking Platform, you acknowledge and warrant that:
- You are at least 18 years of age;
- You will only schedule an appointment with a Provider for yourself or a child or any other individual for whom you have the legal authority to seek healthcare services (“Dependent Individual”);
- You and/or the Dependent Individual for whom you are scheduling the Virtual Services are residents of the province specified by Well.ca for the chosen Provider;
- You will use the Well.ca scheduling webpage in accordance with these terms; and
- You will use the Booking Platform solely for your personal and non-commercial use.
In addition, you acknowledge and agree that Providers always have the discretion to refuse or discontinue the provision of Virtual Services for any reason. You agree to refrain from having an inappropriate conduct towards the Provider, including the use of vulgar and/or insulting language. As a user of the Booking Platform, you acknowledge that there is a risk that your personal information, including personal health information, may be intercepted or disclosed to third parties when using video or audio communications tools. To help keep your information safe and secure, you can:
- Understand that emails, calls, or texts you receive are not secure in the same way as a private appointment in an exam room.
- Use a private computer/device (i.e., not an employer's or third party's computer/device), secure accounts, and a secure internet connection. For example, using a personal and encrypted email account is more secure than an unencrypted email account, and your access to the Internet on your home network will generally be more secure than an open guest Wi-Fi connection.
Well.ca is not a healthcare provider and does not provide medical advice or care
Well.ca provides users with the Booking Platform which displays a variety of Healthcare Professionals or Non-Professional Healthcare Providers. All Providers are independent contractors and Well.ca does not employ or otherwise control the Providers or the content of the Healthcare Services that you will receive after scheduling your appointment via the Booking Platform. As such, Well.ca shall in no way be considered as a party to the relationship between yourself and your chosen Provider.
Well.ca does not recommend or endorse any specific Providers, medications, products or procedures. Well.ca does not make any representations or warranties about the training or skills of the Providers displayed and made available to you for appointment scheduling through the Booking Platform. You are ultimately responsible for the choice of your Provider and assume full responsibility for all risks associated therewith.)
The Providers shall be solely and fully responsible for the accuracy, quality, completeness, reliability, timeliness and appropriateness of the Virtual Services they render to you. You understand that all information provided by the Providers comes solely from them, and is not a reflection of Well.ca’s position towards that information and is not endorsed by Well.ca. Moreover, you acknowledge it is preferable to always seek the advice of your family physician or other qualified healthcare provider concerning any questions you may have regarding any symptoms or medical conditions before scheduling Telehealth Services and/or before stopping or modifying any current treatment or starting a new treatment further to your consultation with a Provider. You should therefore keep your primary care physician informed of the Virtual Services that you receive and the reasons that led you to seek such services.
THE BOOKING PLATFORM SHALL NOT BE USED FOR MEDICAL EMERGENCIES OR URGENT SITUATIONS. IN CASE OF AN EMERGENCY, CALL 911 IMMEDIATELY.
Payment of Virtual Services
Any fees applicable to the Virtual Services (the “Service Fees”) shall be indicated to users prior to the scheduling of the appointment via the Booking Platform. Service Fees are collected by Well.ca via a third-party payment processor (the “Payment Processor”). The Payment Processor will require you to submit valid credit card information prior to the provision of Virtual Services by the Provider. You agree that Well.ca, on behalf of the Provider, may put a hold on your credit card in the amount of the Service Fees. Well.ca shall provide you with a receipt for the Service Fees paid. The processing of payments in connection with the Virtual Services, will be subject to the terms, conditions and privacy policies of Payment Processor and your credit card issuer in addition to these terms.
All Service Fees for Virtual Services shall be in Canadian dollars plus sales taxes, where applicable.
Third-party websites
When using the Booking Platform or Payment Processor, you will be redirected to third party websites. The fact that Well.ca links to a third-party website or service is not an endorsement or a representation of any affiliation with that third party, nor is it an endorsement of their privacy or information security policies or practices. Well.ca does not exercise any control over third party websites or services. By choosing to access or use such third-party services, you agree that such third-party websites and their respective services are provided “as is” and without any warranty of any kind by Well.ca. You shall use such third-party services at your own risk.
Limitation of Well.ca’s liability
UNDER NO CIRCUMSTANCE SHALL WELL.CA OR ANY OF ITS RESPECTIVE DIRECTORS, EMPLOYEES, AGENTS, OR OTHER REPRESENTATIVES BE LIABLE FOR DAMAGES, CLAIMS, EXPENSES OR OTHER COSTS (INCLUDING WITHOUT LIMITATION LEGAL FEES) ARISING OUT OF OR IN CONNECTION WITH THE USE OF THE BOOKING PLATFORM, PAYMENT PROCESSOR OR OTHER THIRD PARTIES OR THE VIRTUAL SERVICES PROVIDED BY HEALTHCARE PROFESSIONALS OR NON-PROFESSIONAL HEALTHCARE PROVIDERS. WELL.CA SHALL NOT HAVE ANY RESPONSIBILITY OR LIABILITY TO USERS RELATED TO THEIR USE OF THE BOOKING SERVICES, PAYMENT PROCESSOR OR THE VIRTUAL SERVICES PROVIDED BY HEALTHCARE PROFESSIONALS OR NON-PROFESSIONAL HEALTHCARE PROVIDERS.
Indemnification
You agree to indemnify, defend and hold harmless Well.ca, its officers, directors, employees, agents and licensors from and against all losses, expenses, damages and costs, including reasonable attorneys' fees, resulting from your use of the Booking Platform or your violation of these terms and conditions or any activity (including negligent or wrongful conduct) related to your use of the Booking Platform.
Privacy
During your consultation with a Provider in the course of the Virtual Services, you will be asked to provide the Healthcare Professional or Non-Professional Healthcare Provider with certain personal information, including personal health information (the “PHI”) (collectively the “Personal Information”). Any such Personal Information collected by the Providers in the course of the Virtual Services will not be disclosed by the Providers to Well.ca and/or otherwise collected by Well.ca.
You understand that Well.ca shall in no circumstance be considered a custodian of your Personal Health Information.
With respect to personal information that may be collected, used or stored by Well.ca further to your use of the Booking Platform, such as your name, e-mail address, credit card information, birth date and gender, the terms of Well.ca’s privacy policy will apply: https://well.ca/privacy.html. By providing your personal information to Well.ca, you agree to let Well.ca collect, use, or disclose your Information through video, electronic or audio communications (while following applicable privacy laws) to the Provider (either directly or via the Booking Platform third party providers) in order to provide you with access to the Provider’s services.
